1. Introduction .
1.1 This Agreement is a legal document which sets out your rights and obligations in relation to this website and the Services referred to in Clause 2 offered through www.parkingappeals.co.uk ("the Website") by Parking Appeals Ltd.(Company Registration Number: 5988571 Registered Address: 14 Witney Way, Hi-Tech Village Boldon, Tyne and Wear NE35 9PE)
1.2 By registering for or using the Parking Appeals Ltd service, you agree to the terms of this Agreement, and you reconfirm your agreement every time you use it.
1.3 Without prejudice to the generality of the foregoing Users of the Parking Appeals Ltd. website and / or any of Parking Appeals Ltd.'s services similarly affirm that they are bound by the Terms and Conditions of this Agreement each time they access the Parking Appeals Ltd. website or Service and fully accept the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must not use or immediately stop using the Website / Services.
1.4 You should be aware that this Agreement may change from time to time in accordance with Clause 22 below and we reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Website / Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.
1.5 This site is for motorists who wish to appeal against incorrect Penalty Charge Notices ("PCN") in respect of alleged Decriminalised Parking Contraventions, Congestion Charging violations or incorrect Clamping & Removal Charges, incorrect Bus Lane fines and incorrect Congestion Charge Clamping & Removal, and appeals or representations against tickets issued on private land and Fixed Penalty and Excess Charge Notices issued under the 1984 Road Traffic Regulation Act.
2. Users of the Parking Appeals Ltd website and/or Services .
2.1 Individuals or Companies who register for or use the www.parkingappeals.co.uk website or Services ("User", "Users") must in the case of individuals be at least 18 years of age. For the avoidance of doubt any persons visiting the www.parkingappeals.co.uk website or using the Parking Appeals Ltd Services are referred to collectively as "Users".
2.2 Individuals and Companies ("members", "member", "users", "user",) that register to use the Parking Appeals Ltd website service automatically become members of the Parking Appeals Ltd service and agree to pay a Subscription Fee of £9.99 for an annual membership. This subscription will renew automatically at the end of 12 months but can be cancelled at any time.
2.3 Registration and subscription entitles Members to:
· Access to all unrestricted areas of the site.
· Access to regular news and information updates through the site.
· Access to background papers and copies of adjudication decisions and shared successes from other members.
· The right to have pro-forma and standard letters generated by the Parking Appeals Ltd service free from the downloads section.
· All benefits of membership including access to all other Services provided by Parking Appeals Ltd. which may require further payment for additional services.
Please note that we are not an Internet service provider. In order to avail yourself of the Parking Appeals Ltd Service via www.parkingappeals.co.uk you must have Internet access and all the appropriate hardware and software, skills and equipment required for email and web usage.
3. Registration . You undertake to register for the Parking Appeals Ltd Service using accurate and current information about yourself – including your correct name, address and any other details required or requested.
· You undertake, should you require a pro-forma or standard letter download from our range of services in respect of each PCN to be challenged, to log your information relating to that PCN ideally within 3 (days) days of the alleged contravention having taken place. You may log your information up to 21 days from that date but you should be aware that you may have lost the right of paying a reduced fine if you subsequently decide to pay the PCN.
· You undertake, should you require a paid for download from our range of services, in respect of each Notice to Owner ("NTO") to log your information relating to that NTO ideally within 6 (days) days of the date of the NTO. You may log your information up to 21 days from that date but you should be aware that you may have lost the right of paying a reduced charge or fine if you subsequently decide to pay the PCN. You should make a note of the date that you received the NTO and retain the envelope it came in as councils often send the NTO out several days after the date shown on the NTO.
· You undertake, should you require a paid for download from our range of services, in respect of each Notice of Rejection ("NOR") to log your information relating to that NOR ideally within 6 (days) days of the date of the NOR. You undertake, in respect of each NOR to show in the additional information part of your appeal the date of the NOR. An appeal after receiving a NOR will go to the appropriate Parking Adjudication Service (either PATAS, the Parking and Traffic Appeals Service, for cases involving one of the 33 London Boroughs or Transport for London; or NPAS, the National Parking Adjudication Service with regard to cases involving local authorities outside of London.
· You undertake, at this point, to ensure that you deal with the appropriate Parking Adjudicator and not the local authority that issued the NOR when submitting your appeal. You should make a note of the date that you received the NOR and retain the envelope it came in as councils often send the NOR out several days after the date shown on the NOR.
· You also undertake to supply to Parking Appeals Ltd completely accurate information about yourself, any parking or other incident in respect of which a PCN has been issued should we be required to assist or advise in relation to any part of the appeal.
· You also undertake not to abuse the service or use it for any malicious, illegal or inappropriate purpose.
· If you are asked for, and provide details of a credit, debit or charge card, you must ensure that (a) you are fully entitled to use that card, and (b) it has sufficient available funds or credit to cover the charges which are deducted from it.
· As part of the registration process for the Parking Appeals Ltd Service, you may receive a verification email, the purpose of which is to take reasonable steps to ensure that the email address you have nominated during registration is controlled by you. That email will contain simple instructions for you to follow.
· Should you use any of the other Services provided by Parking Appeals Ltd. you may be required to submit to further, and more specific terms and conditions.
4. Privacy Policy .
4.1 Parking Appeals Ltd Privacy Policy forms part of this Agreement, and by agreeing to its terms, you also give your consent to the way we may handle your personal data. We are committed to responsible data management and subscribe to the principals of the data protection legislation in the United Kingdom. We are committed to maintaining the privacy of our users and maintaining the security of any personal information received from you. If you register for any of the Services you will be asked to provide basic personal information. Any posting on a public area of the www.parkingappeals.co.uk website (including any which contains personal information) is accessible to Internet Users around the world. The information provided by you is used solely for notifying you of changes or updates to the Parking Appeals Ltd. Website/Services and offering similar associated services.
4.2 The information provided by you may be made available for sale or use by third parties but only with express consent of the registrant. A disclaimer is offered to every registrant.
5. Parking Appeals Ltd Position . You, acknowledge that we are not and cannot be held responsible for the information placed by Users – whether on the www.parkingappeals.co.uk website, the forum or outside of it. In particular, you should be aware that Parking Appeals Ltd. does not pre-screen or monitor the information contributed by Users. Once any appeal has been sent in your name Parking Appeals Ltd has no further responsibility. It is solely your responsibility to deal with the council involved or Transport for London thereafter. Parking Appeals Ltd. will act in relation to individual cases upon receipt of written authority and under any agreement provided in associated additional Services.
6. Additional services .
6.1 Parking Appeals Ltd or its affiliates may from time to time offer new or additional services through the Parking Appeals Ltd website. Your use of those services may be subject to additional terms and conditions, or rules of use, with which you must comply. Provided that those terms or rules are notified to you on the www.parkingappeals.co.uk website in an appropriate manner (as determined by Parking Appeals Ltd in its reasonable discretion), any failure by you to comply with a material provision of the terms or rules governing those services will amount to a breach of this Agreement.
7. Operation of Parking Appeals Ltd Services. Parking Appeals Ltd reserves the right to withdraw or modify one or more aspects of the Parking Appeals Ltd Service or the website www.parkingappeals.co.uk where we have legal, administrative or technical reasons to do so (including technical difficulties experienced by Parking Appeals Ltd or on or via the Internet). There may also be times when the Parking Appeals Ltd Service becomes unavailable, whether on a scheduled or unscheduled basis. For security or other reasons, we may require you to change the User name or Password with which you gain access to the Parking Appeals Ltd Service.
8. Misuse of Parking Appeals Ltd Services.
8.1 We reserve the right to suspend or terminate any User's access to the Parking Appeals Ltd Service or www.parkingappeals.co.uk, or parts of it, and/or to edit, or require the User to edit, material posted on the www.parkingappeals.co.uk website or any forums controlled by Parking Appeals Ltd, if the relevant User or the posted material appears to us to be in breach of any provision of this Agreement.
8.2 Any person whose access has been suspended or terminated must not re-register for, or re-access, directly or indirectly, the Parking Appeals Ltd Service or Website without our prior consent. You are responsible for everything that is done on or through the www.parkingappeals.co.uk website while your User account is logged on to the Parking Appeals Ltd Service or while you are visiting or using the Parking Appeals Ltd Service, or through your email address.
9. Appropriate and Inappropriate Use .
9.1 The Parking Appeals Ltd Service is intended to be used by its Users for the purposes referred to in Clause 2 above. A User may not allow others to use or share membership.
9.2 In using the www.parkingappeals.co.uk Website and /or Parking Appeals Ltd. Services or information gathered from or provided by, you agree not to:
9.2.1 use the Services to send junk email, spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise;
9.2.2 post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful;
9.2.3 post, publish, distribute or disseminate material or information that incites discrimination, hate or violence towards any person or group on account of their race, religion, disability, nationality or otherwise;
9..2.4 threaten, abuse, disrupt, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of others;
9..2.5 use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party;
9.2.6 make available or upload files that contain a virus, worm, Trojan or corrupt data that may damage the operation of the computer or property of another;
9.2.7 collect or store personal information about others, including email addresses;
9.2.8 advertise or offer to buy or sell goods or services for any commercial purpose, unless such communication facility specifically allows such messages;
9.2.9 impersonate any person or entity for the purpose of misleading others;
9.2.10 violate any applicable laws or regulations;
9.2.11 use the Website/Services in any manner that could damage, disable, overburden or impair the Website/Services or interfere with any other party’s use and enjoyment of the Website/Services;
9.2.12 post, publish, distribute or disseminate material or information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information or confidential information disclosed in the course of employment or under a confidentiality agreement);
9.2.13 attempt to gain unauthorised access to any of the Services, other accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.
9.3 Users must not place, without prejudice to the generality of the foregoing, any material on, or otherwise use, the Parking Appeals Ltd Service for any business or commercial purpose, or place, without prejudice to the generality of the foregoing, any material on the Parking Appeals Ltd Service which is illegal, or otherwise use the Parking Appeals Ltd Service or Website for any illegal purposes.
9.4 Usersmay not place, without prejudice to the generality of the foregoing, any material on the Parking Appeals Ltd Service which is libellous, or otherwise use, the Parking Appeals Ltd Service for any libellous purposes.
9.5 Users must not include an email address, postal address, phone number, the address of any website, or any other information or material which is not specifically germane and required for the appeal on the Parking Appeals Ltd Service.
9.6 We have no obligation to monitor the Services but shall be entitled to review materials posted to a communications facility and, at our sole discretion, to remove any material that breaches these Terms and Conditions or is otherwise objectionable.
10.User Account, Password and Security
When a particular Service requires you to open an account you will be required to complete the registration process by providing certain information and registering a user name and password for use with that Service. You are responsible for maintaining the confidentiality of the user name and password and also for all activities which take place under your account. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. 11. Fees
11.1 You acknowledge that we are entitled to alter the amount and / or the basis of the calculation of our fees from time to time, provided that such amount or basis is clearly stated at the time that you agree to make use of the relevant Parking Appeals Ltd Service.
11.2 Refunds : The User by registering, entering or using the website, agrees that the supply of services by us has begun before the end of the cancellation period applicable under regulation 12 of The Consumer Protection (Distance Selling) Regulations 2000 and accordingly fees paid by a User will not be returned or refunded in whole or in part by Parking Appeals Ltd , unless, in the exceptional circumstances that the Parking Appeals Ltd Service for which the User has paid for has not been actioned by us within 28 days of the information being submitted to the website.
11.3. We may add new or ancillary or associated services from time to time that require the payment of fees, either to us or a nominated third party, on terms which will be provided to you at the time.
11.4 If we are not successful in achieving refunds within 12 months after a subscription has been paid then we will refund the £9.99 subscription with 7 days of a request being made.
12. Prohibitions. You are responsible for ensuring that no material you post, or which is posted through any device on or through which you access the Parking Appeals Ltd Service, nor any activity or communication you make in connection with any Parking Appeals Ltd Service, will be capable of (a) infringing the intellectual property or other rights of any person or entity, (b) breaching any applicable law, whether criminal, tortuous or otherwise, or (c) appearing to be offencive, threatening, obscene, pornographic, false, unreliable or misleading.
13.Links to Third Party Websites
The Website/Services may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that www.parkingappeals.co.uk is not responsible for the content or availability of any such sites.
14.Alerting Parking Appeals Ltd.
14.1 If you see anything on the Parking Appeals Ltd website which appears to infringe this Agreement, then please contact us to inform us by emailing us at the e-mail address on the home page or enquiries@parkingappeals.co.uk
14.2 Each User acknowledges that we do not / may not continually monitor material which appears on the Parking Appeals Ltd Service, and that we are reliant upon you and all Users to notify us of anything you see here which appears likely to breach this Agreement, using the notification techniques which are made available on the www.parkingappeals.co.uk Website
15. Withdrawal of material. Each User acknowledges that we are entitled to withdraw any material on the Parking Appeals Ltd Service which appears whether based on information received from Users or others, or our own determination to be capable of breaching any part of this Agreement, or of bringing the Parking Appeals Ltd Service into disrepute.
16.Termination of Agreement We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without
limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior
notice and you agree that we shall not be liable to you or any third party for any termination of your access to the Website/Services.
17. Disclaimer and Release. www.parkingappeals.co.uk operated by Parking Appeals Ltd. and Services offered by Parking Appeals Ltd.
17.1 The site has been constructed to the highest quality and the accumulated knowledge has come from years of experience at the 'sharp end' of the parking industry as well as from thousands of successful cases. Indeed, following our investigations, reports and exposes local authorities have been forced to write off hundreds of millions in unlawfully issued fines and thousands of motorists have received refunds.
17.2 We do advise that you do not use this website as your only source of advice or reference.
17.the basic principles shown on this website are borne out of an understanding of the processes involved in Decriminalised Parking Enforcement, and other Civil Enforcement matters, an in depth knowledge of traffic and signing legislation and a complete understanding of the local authorities' and adjudication services' appeals processes.

17.10.11 You acknowledge that by entering the Parking Appeals Ltd site you acknowledge that we may contact you by e-mail, post, fax or SMS text messaging to send you information relating to the use of the site or for any advertising purposes whatsoever.
17.10.12 You acknowledge and accept that Parking Appeals Ltd produces the letters referred to above based on its interpretation of the rules and legislation relating to fines or charges levied in respect of alleged parking or Congestion Charging violations or incorrect Clamping & Removal Charges, incorrect Bus Lane fines and incorrect Congestion Charge Clamping & Removal and shall not be held responsible for any failure (whether due to our action or inaction or misinterpretation of the law) of any appeal for any reason whatsoever.
17.10.13 You acknowledge that you accept that you have no proprietary right or interest in any part of the www.parkingappeals.co.uk website, nor any rights or intellectual property of the any material or reports produced by Parking Appeals Ltd. website.
17.10.14 You acknowledge that Parking Appeals Ltd reserves the right at its sole discretion not to allow you to use its service once you have logged in, if for technical reasons it cannot provide the service to you.
17.10.15 You acknowledge accordingly, to the extent that the law permits, you release Parking Appeals Ltd, its directors, contractors and employees from all liability arising out of or in connection with the Parking Appeals Ltd Service and the material included on it by Users and other third parties.

17.10.17 Nothing in these Terms and Conditions shall affect your statutory rights as a consumer.

in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet. www.parkingappeals.co.uk and Parking
Appeals Ltd. does not relate to parking matters outside the United Kingdom.
19. Intellectual Property Rights
19.1 The Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website
and the Services) are protected by copyright, trade marks, patents and other intellectual property rights and laws. In accessing the Website you agree that you will
access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or
distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal,
non-commercial use only.
19.2 www.parkingappeals.co.uk does not claim ownership of any materials you post, upload or submit to any publicly accessible area of the Services. However,
by doing so you are granting us a world-wide, royalty free, non-exclusive licence to copy, distribute, transmit, reproduce, publicly display, edit, translate or publish
such Content for as long as you elect to display such Content via the website and the Services. The licence shall be terminated when such Content is deleted from
the website or the Services.
By submitting any material to the content to the Parking Appeals Ltd Service or website, you are representing and you acknowledge that you are fully entitled to do so and;
• grant us a non-exclusive, royalty-free, non-terminable licence right to copy, modify, distribute, show in public and create derivative works from that material in any form, anywhere; and

20 Excluded loss . We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). Parking Appeals Ltd will also not be liable for any failure to perform its obligations under this Agreement caused by circumstances beyond its reasonable control.
21 Maximum liability . Without limiting the preceding clause, during any period of twelve months, the aggregate liability of Parking Appeals Ltd under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed £9.99 (five pounds sterling).
22 Non-excluded liabilities . Nothing in this Agreement limits Parking Appeals Ltd's liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.
23 Indemnity You agree to indemnify and hold www.parkingappeals.co.uk harmless from and against any breach by you, or through a device with which you
access the Parking Appeals website or Service, of these Terms and Conditions and any claim or demand brought against www.parkingappeals.co.uk by any third
party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation, all claims, actions,
proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by
www.parkingappeals.co.uk in consequence of your breach of these Terms and Conditions.
24 Assignment . We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not without the written consent of Parking Appeals Ltd assign or dispose of this Agreement.
25 Entire Agreement . This Agreement includes our privacy policy. Together they constitute the whole of the agreement between us and you concerning the Parking Appeals Ltd Service and website, and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
26. Changes to this Agreement.
26.1 Parking Appeals Ltd reserves the right to change this Agreement from time to time, and post the new version on the www.parkingappeals.co.uk website. When we do so, we will notify you of the fact that there are changed terms on our homepage (www.parkingappeals.co.uk)
26.2 The new version of these terms and conditions will take effect, and will govern all Parking Appeals Ltd Services and your relationship with Parking Appeals Ltd commencing 7 days after the date of posting (or such later date as Parking Appeals Ltd indicates in the relevant posting), if any of the changes is to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when the new version of the Agreement is to take effect, and from that date you must cease to use the Parking Appeals Ltd Service; or
26.3 The new version of these terms and conditions will take effect, and will govern all Parking Appeals Ltd Services and your relationship with Parking Appeals Ltd immediately upon the date of posting (or such later date as Parking Appeals Ltd indicates in the relevant posting), if the changes are not to operative provisions, or not capable of adversely affecting you, examples of which would include, without limitation, changes to one or more of www.parkingappeals.co.uk's addresses or email addresses referred to in this Agreement.
27 Severance If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
