impounded car 
hello all,
i am a first timer here and i've found this site very knowledgeable however, i am in dispute with a wheelclamping company who towed away my car and has demanded that i pay £665.00 plus £175.00 if they tow it back (cannot be driven due to no tax)i have explained my current situation but, they say if they crush my car i will still have to pay them the full amount or they will take it to the bailiffs and court. my car was parked on my own allocated parking space but because the land is private my housing has contracted these nasty piece of work to remove any untax car. does anyone know if i have a case against them tuesday is the deadline i am a student with a young family .....i need justice on this case please help if you can ...thanks

Hi & welcome - a few questions to clarify! Have you paid seperately for your parking space or is it included in rent? Is there any indication to you that you are not allowed to keep an untaxed vehicle in your parking space? Who is the landlord ie private / public authority? have you comepleted a SORN Statutory Off Rd Notification to DVLA about your car? What is the contractors company name? Can you break down the bill is it all a removal fee or is part of the £665 storage fees?

my housing is on private land, the wheelclampers 'ces' have been contracted by my housing to remove any untax car i notified dvla i needed a sorn cerificate, my car had failed the mot and i wanted time to get the repair done to it so i can get it mot and taxed.i was told to pay the money which includes a daily fee.

Hi Sammy and Mike, There is much you can do with this albeit some options are limited to your tenancy agreement/lease and the sign upon which the clampers rely. Can you take a picture of the clampers sign first (most important) and insert the the picture of the sign and the tenancy agreement/lease without personal details using the insert image icon above? An untaxed car is not illegal if it is SORN and on private land, much will depend on what is written in your tenancy agreement and what the sign says, they cannot simply remove your vehicle because it doesn't have a tax disk.

If you do pay these people, then use a credit card as this can be charged back. Please post or copy the text from the info above asap and we can help further, cheers.

SammyandMike.Thre was a story around a week or two ago that hit the national newspaper.I can't remember if it wass Lidl or Aldi, but basically  a driver had left his car in the car park for a few hours, and it was lifted and taken to a compound.the driver used a little known law stating that the clamping company were legal in removing the car from the car park, but however, they were not in their legal right to take it tom a compound.I thought I had the story saved on my p.c. but I can't find it.It was posted on Pepipoo(free registration).If I come across the dstory I will post it for you.
