Asda car park manchester 

I parked in a disabled bay which i know was wrong, i did have a child with me but all todler spaces were full, on arrival back to my car a warden was approaching, i ran to the car and drove away, their was no ticket fixed anywhere to my veichle yet i recieved a letter in the post stateing that a ticket had been afixed to the car and issued, i have a witness whoo will testify that no such issue took place and no such ticket was placed anywhere on my veichle, i requested that we go to court to settle the matter but have just recieved a final notice before the debt recovery team are despatched. I was under the impression that before they could employ the use of a debt recovery service they had to find that i was in the wrong through the courts, is this the case? I am not contesting the fact that i was parked in a Disabled sppace i am conmtesting the fact that no ticket was issued.

I am not an expert on Private Parking, which I think this may be, since you posted it here.... Pls clarify IS it private parking or Council?

Private schemes are almost unenforceable, as far as I know, --- as I said  - v  little, and they rely on bullying and threats to gain the revenue.

Otherwise YOU have a LEARNING CURVE ahead........under the old RTA 1991, a PCN must be served in hand or on the screen.

IF not then you can file a representation - appeal against improper service.

The New Tma came into force a few days ago, and your thread sugegsts this was some time ago...

and call TEC the number is there, and ask IF the debt is registered, and WHY did you not get a notice of debt registration and appeal form?

THEN download the form N244, P2 / P3 the same, TEC are helpful. And file an appeal, and the bailiff process should be stopped pending a council decision.

If the council reject your appeal then you can ask for it to come to the local county court. Keep watching the process at TEC, and warn/ write.....  the bailiffs to stay away while an appeal is pending, otherwise they break the law.

All that is free.

 

If it is private, then I am not the expert, suggest you clarify this more, perhaps scan the PCN, and let others here see it.

If Asda's car park is private then you have nothing to worry about.Their disabled bays cannot be legally enforced neither can their mother and toddler bays.It is basically first come gets the space.I recall a seller going to asda and parking in a disabled bay.She was asked by the management to move her car, but refused.And the result? Because Asda knew they could not legally enforce the bay, and the seller refused to move her car, she was banned from asda.What a pity Tesco were not close by.
